We do not guarantee that:

- every tool, download, software product, or resource will work with every device, browser, operating system, software version, configuration, file type, or third-party service;
- every defect, error, or technical issue will be corrected;
- any particular feature, product, integration, resource, or service will remain available indefinitely; or

5. User Responsibility and Backups
You are responsible for evaluating and safely using any software, tools, downloads, instructions, workflows, scripts, templates, assets, or other resources obtained through Digital Design Hub.
Before using software or tools that modify, process, convert, resize, overwrite, export, delete, transform, or otherwise interact with files or data, you should maintain appropriate backups.
You are responsible for maintaining copies of files, projects, data, account information, credentials, and other materials that are important to you.
To the fullest extent permitted by law, we are not responsible for losses caused by failure to maintain reasonable backups.
6. Privacy, Analytics, and Data Collection
Your use of Digital Design Hub is also subject to our Privacy Policy.
Depending on the services you use, information processed in connection with Digital Design Hub may include:
- contact information;
- website usage and page-visit information;
- browser and device information;
- marketing-attribution and referral information;
- UTM parameters and similar campaign information;
- information stored through cookies, localStorage, or similar technologies;
- transaction, purchase, subscription, or download information;
- software or product-related information;

7. Accounts and Account Security

- activities performed through your account to the extent permitted by law.

8. Software, Web Tools, and Applications
Digital Design Hub may develop, distribute, sell, promote, recommend, or provide access to software applications, web-based utilities, plugins, scripts, tools, APIs, or similar products.
Specific software products may be subject to additional license terms, marketplace terms, purchase conditions, usage limits, subscription conditions, or third-party platform rules.
Unless expressly stated otherwise, access to software does not transfer ownership of the software, source code, intellectual property, underlying systems, or associated proprietary technology.
Where software is distributed through a third-party marketplace or platform, your acquisition and use may also be subject to that marketplace or platform's terms and policies.
9. Digital Assets and Downloads
Digital Design Hub may provide downloadable assets such as templates, images, graphics, icons, presets, files, guides, documents, datasets, code, or other digital resources.
Unless different terms are expressly provided with a particular asset, downloads are licensed for their intended use and are not sold as ownership of the underlying intellectual property.
You may not redistribute, resell, sublicense, republish, or commercially exploit downloadable resources as standalone products unless expressly permitted by the applicable license.
Certain resources may be subject to separate license terms that supersede this section with respect to that resource.
10. Purchases and Payment Terms
Digital Design Hub may offer paid products, software, subscriptions, licenses, downloads, services, or other purchases.
By completing a purchase, you agree to the pricing, billing, renewal, usage, and other terms presented during the applicable checkout or purchasing process.
10.1 Payment Processing
Payments may be processed by third-party payment processors, marketplaces, app stores, commerce providers, or subscription-management platforms.
Your use of those providers may also be subject to their terms, privacy policies, payment rules, and transaction procedures.
10.2 Subscription Products
Products or services may be offered through recurring monthly, annual, usage-based, or other subscription arrangements.
Where a subscription automatically renews, the applicable renewal interval, price, and cancellation procedures will be disclosed through the applicable purchasing system.
10.3 Free Trials and Promotions
We may offer free trials, discounts, coupons, introductory prices, promotional offers, or other incentives.
Specific conditions associated with such offers will be disclosed in connection with the promotion or applicable purchasing platform.

Applicable taxes, duties, or similar charges may be collected where legally required.
11. Refunds and Cancellations
Refund and cancellation terms may vary depending on the product, service, marketplace, payment provider, subscription arrangement, and circumstances of the transaction.

Nothing in these Terms limits any refund, cancellation, warranty, or consumer right that cannot legally be waived or restricted.
12. User Content and Submitted Materials
Digital Design Hub may eventually allow users to submit files, text, images, comments, reviews, prompts, designs, feedback, messages, or other materials ("User Content").
You retain ownership of intellectual property rights you lawfully hold in your User Content.
By submitting User Content where processing, display, storage, transmission, or publication is necessary to provide a requested service, you grant us a limited license to use that content to the extent reasonably necessary to provide, operate, support, secure, and improve that service.
You represent that:
- you have the necessary rights and permissions to submit the content;
- your submission does not violate applicable law;
- your submission does not infringe third-party intellectual-property, privacy, publicity, contractual, or other rights; and
- your submission does not contain malicious code or content intended to harm our systems or users.
13. Acceptable Use and Prohibited Activities
You agree to use Digital Design Hub lawfully and responsibly.
You may not:
- use Digital Design Hub for unlawful, fraudulent, deceptive, abusive, or malicious purposes;
- attempt to gain unauthorized access to accounts, systems, databases, servers, APIs, storage, infrastructure, or administrative functionality;
- introduce malware, viruses, malicious scripts, destructive code, or other harmful material;
- interfere with, overload, damage, disable, probe, scrape abusively, or disrupt the website or its infrastructure;
- circumvent authentication, licensing, subscription, payment, access-control, rate-limit, or usage-limit mechanisms;
- use automated systems in a manner that imposes unreasonable loads or bypasses technical restrictions;
- impersonate another person or misrepresent your identity or affiliation;
- use Digital Design Hub to infringe copyright, trademark, privacy, publicity, contractual, or other rights;
- redistribute paid or licensed products, software, assets, or downloads without authorization;
- reverse engineer, decompile, or disassemble protected software except where restrictions on such activities are prohibited by applicable law; or
- use the website in a manner that materially interferes with other users or our ability to provide services.
14. Intellectual Property
Unless otherwise indicated, Digital Design Hub and its original website content, designs, software, source code, interfaces, tools, graphics, articles, documentation, branding, databases, downloadable resources, and other proprietary materials are owned by Digital Design Hub or applicable licensors.
These materials may be protected by copyright, trademark, trade-secret, and other intellectual-property laws.
Except where expressly permitted by applicable law or a specific license, you may not:
- copy, reproduce, republish, distribute, sell, sublicense, or commercially exploit protected materials;
- remove or alter copyright, trademark, attribution, or proprietary notices;
- misrepresent ownership of our content or products; or
- use our branding in a manner that falsely implies sponsorship, ownership, endorsement, or affiliation.
15. Third-Party Intellectual Property
Digital Design Hub may discuss, review, reference, link to, or provide information about third-party companies, software products, platforms, marketplaces, brands, tools, services, or technologies.
Third-party trademarks, logos, product names, copyrighted materials, and other intellectual property remain the property of their respective owners.
References to third-party products or companies do not necessarily imply affiliation, sponsorship, endorsement, partnership, or ownership unless expressly stated.
16. Third-Party Links, Services, and Platforms
Digital Design Hub may contain links to or integrations with third-party websites, marketplaces, software, services, APIs, payment providers, social platforms, cloud providers, artificial-intelligence systems, or other technologies.
These third parties operate independently and are governed by their own terms, policies, technical limitations, pricing, and business decisions.
We do not control and are not responsible for:
- third-party content;
- third-party privacy or security practices;
- service outages or discontinuations;
- changes to third-party pricing or functionality;
- third-party purchases or transactions;
- third-party errors or technical limitations; or
- other actions or omissions of third-party providers.
17. Affiliate Links, Sponsorships, and Commercial Relationships
Digital Design Hub may use affiliate links, referral links, sponsorships, advertising relationships, promotional arrangements, or other commercial partnerships.
Where legally required, appropriate disclosures will be provided in connection with sponsored, affiliate, promotional, or compensated content.
The existence of a commercial relationship does not guarantee that a referenced product or service will be appropriate for every user.
18. Artificial Intelligence and Automated Tools
Digital Design Hub may provide information about or access to tools that use artificial intelligence, machine learning, automated processing, generative technologies, or third-party AI services.
Outputs produced by automated or AI-based systems may contain errors, inaccuracies, unexpected results, or material requiring human review.
You are responsible for reviewing generated outputs and determining whether they are appropriate, lawful, accurate, and suitable for your intended use.
You are also responsible for complying with any third-party terms, licensing restrictions, intellectual-property requirements, or platform rules that apply to AI-generated or AI-processed material.
19. Customer Support
We may provide support regarding Digital Design Hub, software, tools, purchases, downloads, or other products and services.
Support is provided subject to availability. We do not guarantee:
- a particular response time;
- a particular outcome or resolution;
- that every technical issue can be reproduced or corrected; or
- indefinite support for every product, feature, platform, or integration.
Abusive, threatening, harassing, or persistently inappropriate communications may result in restrictions on support or communications where permitted by law.
20. Modification or Discontinuation of Services
We may modify, redesign, update, replace, suspend, limit, or discontinue Digital Design Hub or portions of its products and services.
This may include:
- adding or removing content;
- changing website structure;
- adding, changing, or removing software features;
- changing compatibility requirements;
- changing pricing or usage limits;
- changing third-party integrations;
- replacing or discontinuing tools, downloads, products, or services; and
- changing technical infrastructure or delivery methods.
Where required by applicable law, we will provide legally required notices regarding material changes.
21. Suspension and Termination
Where permitted by law, we may suspend, restrict, or terminate access to Digital Design Hub or particular services if:
- you materially violate these Terms;
- fraudulent, abusive, malicious, or unauthorized activity occurs;
- payment obligations remain unresolved;
- your activity creates a security, legal, reputational, or operational risk;
- your use materially interferes with other users or our systems;
- a third-party provider requires restriction of the service; or
- we are legally required to restrict access.
Provisions that by their nature should survive termination will remain effective after termination.
22. Limitation of Liability
To the fullest extent permitted by applicable law, Digital Design Hub and its owners, affiliates, employees, contractors, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your access to or use of Digital Design Hub.
This includes, without limitation, losses relating to:
- lost revenue, profit, business opportunities, goodwill, or anticipated savings;
- lost, corrupted, modified, inaccessible, or deleted files or data;
- business interruption or productivity loss;
- reliance on website content, recommendations, tools, calculations, or outputs;
- software errors or incompatibilities;
- third-party websites, services, marketplaces, platforms, products, or integrations;
- security incidents outside our reasonable control; or
- unavailability or discontinuation of website features, resources, products, or services.
To the fullest extent permitted by law, where liability cannot otherwise be excluded, our aggregate liability arising out of the applicable product or service will not exceed the greater of:
- the amount you paid directly to us for the applicable product or service during the 12 months preceding the event giving rise to the claim; or
- $100 USD.
Some jurisdictions do not permit certain limitations of liability. In those jurisdictions, these limitations apply only to the maximum extent permitted by law.
23. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Digital Design Hub, its owners, affiliates, employees, contractors, agents, and licensors from claims, liabilities, losses, damages, costs, and reasonable legal expenses arising from:
- your material violation of these Terms;
- your unlawful or unauthorized use of Digital Design Hub;
- your violation of third-party intellectual-property, privacy, publicity, contractual, or other rights;
- content, files, data, instructions, or materials you submit or process using our services; or
- your violation of applicable law.
24. Force Majeure
We are not responsible for delays, interruptions, degradation, or failures caused by circumstances beyond our reasonable control.
These circumstances may include:
- natural disasters, fires, floods, earthquakes, storms, or other severe-weather events;
- internet, telecommunications, power, or infrastructure outages;
- cyberattacks, denial-of-service attacks, malicious traffic, or widespread security incidents;
- governmental actions, legal restrictions, sanctions, or regulatory changes;
- labor disputes or supply-chain disruptions;
- failure or discontinuation of cloud providers, APIs, marketplaces, payment processors, software platforms, or other third-party systems; or
- other circumstances outside our reasonable control.
25. Feedback and Suggestions
If you voluntarily provide suggestions, ideas, recommendations, feature requests, corrections, or other feedback regarding Digital Design Hub ("Feedback"), you grant us a worldwide, perpetual, irrevocable, transferable, sublicensable, royalty-free license to use, reproduce, modify, develop, distribute, commercialize, and otherwise use that Feedback without compensation or obligation to you.
This does not transfer ownership of unrelated files, intellectual property, designs, or other content merely submitted for purposes of using a service or receiving support.
26. Governing Law
These Terms and disputes arising from or relating to them are governed by the laws of the State of Kansas, United States, without regard to conflict-of-law principles, except where mandatory laws in your jurisdiction require otherwise.
27. Informal Dispute Resolution
Before initiating formal legal proceedings, you and Digital Design Hub agree to make reasonable good-faith efforts to resolve disputes informally where practicable.
You may begin this process by contacting digital-design-hub@outlook.com and providing a description of the issue and relevant supporting information.
28. Arbitration
To the extent permitted by applicable law, unresolved disputes arising from these Terms may be submitted to binding arbitration before a single arbitrator under applicable rules of the American Arbitration Association.
Arbitration may take place in Douglas County, Kansas, or remotely where agreed or permitted.
Nothing in this section prevents either party from pursuing an eligible claim in small claims court or seeking temporary, injunctive, or other equitable relief where legally appropriate.
29. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.
The remaining provisions will remain in effect.
30. Waiver
Failure to enforce a provision of these Terms does not constitute a waiver of that provision or of our right to enforce it later.
31. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent except where applicable law provides otherwise.
We may assign or transfer these Terms in connection with a merger, acquisition, restructuring, financing, sale of assets, transfer of a business, or similar transaction.
32. Entire Agreement
These Terms, together with our Privacy Policy and any applicable product-specific, purchase, license, or service-specific terms, constitute the agreement governing your use of Digital Design Hub and its applicable products and services.
33. Electronic Acceptance
Where applicable, your agreement through an electronic process—including clicking an acceptance button, checking a box, completing a purchase, creating an account, downloading or installing software, or otherwise taking an action that clearly indicates acceptance—may constitute legally binding acceptance of applicable terms to the extent permitted by law.
34. Changes to These Terms
We may update these Terms to reflect changes in Digital Design Hub, our products, services, business practices, technologies, third-party relationships, or legal requirements.
When these Terms are updated, we may:
- post the updated Terms on Digital Design Hub; and
- update the Effective Date displayed near the top of this page.
Where required by applicable law, we may provide additional notice or obtain consent before material changes take effect.
Your continued use of Digital Design Hub after updated Terms become effective constitutes acceptance of those updated Terms to the extent permitted by applicable law.
